Copy of Agreement and Deed of Charge between Modern Homes (Dublin) Limited, having their registered office at St Andrew’s, Serpentine Avenue, Ballsbridge, Dublin (the contractors) of the one part, and the Right Honourable the Lord Mayor, Aldermen and burgesses of Dublin, being the Urban Sanitary Authority for the Urban Sanitary District of the City of Dublin (the Corporation) of the other part. The contractors covenant with the said Corporation that the former, their successors and assigns etc. shall at their own expense put, maintain and keep in repair the drain or sewer of said the premises as shown on an accompanying map, and described in a schedule to the agreement (property on Gilford Road, Sandymount), or in default thereof that the Corporation be at liberty upon giving to the contractors 48 hours’ notice in writing, to do such work as may from time to time be necessary to put, maintain and keep the same in such repair as aforesaid and thereupon the said contractors, their successors and assigns will from time to time pay to the said Corporation all costs, charges and expenses of putting, maintaining or keeping in repair the common drain or sewer of the premises. A file relating to Mrs Louisa McCann (sister of Fr Laurence Kieran SJ) and the will of her late husband Mr Arthur McCann. The file relates to the financial difficulties experienced by Louisa McCann following the death of her husband, due in part, to the failure of the trustees of her marriage settlement to ensure that £20,000 was put in trust for her widowhood. Her brother Robert Kieran acted as her solicitor. However, it would appear from correspondence between Louisa and her brother Robert and Fr Kieran SJ that Louisa and Robert fell out with each other and she eventually asked Fr Kieran SJ to act as mediator and to look after the legalities of the estate. Includes a letter from Louisa McCann, Teltown, Donaghpatrick, Navan, County Meath to Fr Kieran, S.J. Remarks '...Bob's behaviour has certainly been awful and his letters all trumped up nonsense...he knows my unfortunate position and is taking advantage of it...I could not have believed he would have turned on me as he has done...I have you at any rate - otherwise I am really a very desolate creature now - struggling hard to pull along and trying not to be a burden on anyone.' (15 June 1938, 2pp). Includes a copy letter from Fr Kieran SJ, Clongowes Wood College, county Kildare to his brother Robert Kieran concerning the disagreement that has arisen between Louisa and Robert. Remarks 'I have often asked you to control your temper and your nerves - you have not done so; on the contrary, I regret to say you are getting steadily worse; so much so that I have often asked myself in sorrow where it is all going to end. Are you any the better now do you think for having inflicted this pain upon one who is poor, defenceless and alone in the world, and do you really believe that in doing this act you have given good example to your children?' (19 June 1938, 2pp). Includes a copy letter from Louisa McCann to her brother, Robert Kieran. Remarks 'I appreciate that you have had no end of trouble or worry over the McCann estate...but your recent attitude and behaviour towards me has made it impossible for me to approach you any further - I am sending the documents to Lal (Fr L Kieran SJ)...I have every confidence in him and shall be directed by what he advises...' Terms and conditions:
In consideration of the expense incurred by the lessee company in the erection of the eight messuages upon the above property, and of the several rents and sums of money reserved and made payable in the present lease and the covenants and agreements made by the lessee company and conditions, the lessor, by virtue and in exercise of the powers conferred on him by the will of 20 May 1904 by the Right Honorable Sidney, late Earl of Pembroke and Montgomery, and by the Settled Land Acts of 1882 to 1890, and with the consent of Lord Herbert, demises unto the lessee company the above property to hold from 29 September 2019 for the term of 72 years, paying the yearly rent of £126, and also paying during the said term the several additional contingent rents or weekly sums set down in the lease. The lessee company also undertakes to abide by the several other conditions laid down in the lease, including the construction of two roadways with footpaths, drains and sewers, and also the erection of 34 additional messuages or dwellinghouses, with all necessary cartilages, garages, out-buildings, offices, walls, fences, sewers, drains etc. The lessee company to pay to the lessor the yearly rent of £45.

A file relating to revisions of the Custom Book of the Irish Jesuit Province. Includes a letter informing of the decision taken by Fr General to revise the Custom Book of the Irish Jesuit Province (15 December 1934, 1p). Includes two minutes books of the Custom Book Commission. Details suggested changes. The minute books are in the handwriting of Fr John MacErlean SJ who was the secretary of the Commission (15 December 1934 - 7 June 1935, 51pp; 18 January - 7 June 1935, 43pp). Includes a letter from Fr John MacErlean SJ, Milltown Park, Dublin to the Irish Fr Provincial concerning protests against altering the Custom Book. Remarks 'I put in (a notebook) everything that came into my head that might be made use of in building up our protest.' (10 April 1940, 1p). – censors’ judgements on the manuscript of a sermon on ‘Sin’ by Fr Sheil (Jun 1936, 2 items); copy of summary of censors’ judgements (n.d., 2pp) and letter from Fr Sheil to the Irish Fr Provincial after receiving the censors’ reviews (24 June 1936, 2pp);
– letter from Fr Sheil in which he explains his delay in sending the Irish Fr Provincial the texts of his sermons, ‘My delay, and indeed serious negligence, has not been due, I think, to wilful disobedience, or to the opinion that they did not need censoring, but to this. I have eight fully written sermons in my drawer at present, but my dissatisfaction with them has caused me to cross out and amend lines and pages, so that none of them are yet in fit condition to send.…also…between missions my head is so tired that I am loathe to work.’ Also refers to the Sodality and the Legion of Mary (see J16/3) (12 Oct. 1936, 2pp);
– copy letter to Fr Sheil from the Irish Fr Provincial calling attention to Fr Sheil’s ‘want of prudence and discretion’ and warning him that if he continues ‘on present lines’ he may be ‘removed from the mission staff and given work in a College. With a view to rendering such a change unnecessary I forbid you in future to speak in the pulpit on questions of sex or, on general, matters relating to the VI commandment, without having first submitted your MS to the Socius for censorship. I wish also that you give up mentioning in public estimates or conjectures regarding the number of Irish emigrants who lose the faith or give up its practice’ (24 Jan. 1938, 2pp);
– note from Fr Sheil to the Irish Fr Provincial in which he lists the topics of his sermons that have been passed by the censor (12 Mar. 1940, 3pp);
– letter from Fr Tom Counihan SJ to ‘Fr. John’ in which he refers to Fr Sheil’s sermons, ‘You should have heard his sermons on sin, temptation, holyhour, family life & Holy Communion to feel utterly ashamed of the twaddle neither here nor there (sic.) No Scripture, no sound reasoning & abundance of crudity & naked realism…It is very unfortunate & I am not at all comfortable when I have to hand over an out-church to his tender mercies!’ (15 May 1940, 2pp) and
– copy letter from the Irish Fr Provincial to Fr Sheil in which he states, ‘I have been regretfully obliged to change you from the mission staff, and it is only fair that you should know the reason of this change. From information I have received from many different quarters it seems clear that you are greatly lacking in prudence in the things you say; and I cannot help thinking that if you were allowed to continue working as a missioner you would land both yourself and the Society into serious trouble…you allow your zeal to get the better of you with the result that you act contrary not only to the advice of your colleagues but also to that of your Superiors. I am afraid also that your knowledge of theology is very much wanting in accuracy…As to your work in Galway in the coming year, I must forbid you to preach anything in the Church without first having shown the MS to Fr Rector…’ (30 Jul. 1940, 2pp).
