Terms and conditions:
In consideration of the expense incurred by the lessee company in the erection of the eight messuages upon the above property, and of the several rents and sums of money reserved and made payable in the present lease and the covenants and agreements made by the lessee company and conditions, the lessor, by virtue and in exercise of the powers conferred on him by the will of 20 May 1904 by the Right Honorable Sidney, late Earl of Pembroke and Montgomery, and by the Settled Land Acts of 1882 to 1890, and with the consent of Lord Herbert, demises unto the lessee company the above property to hold from 29 September 2019 for the term of 72 years, paying the yearly rent of £126, and also paying during the said term the several additional contingent rents or weekly sums set down in the lease. The lessee company also undertakes to abide by the several other conditions laid down in the lease, including the construction of two roadways with footpaths, drains and sewers, and also the erection of 34 additional messuages or dwellinghouses, with all necessary cartilages, garages, out-buildings, offices, walls, fences, sewers, drains etc. The lessee company to pay to the lessor the yearly rent of £45.

A file relating to the road widening scheme at Rathfarnham and work carried out by Dublin Corporation on part of the boundary wall of Rathfarnham Castle and the subsequent problems that arose due to the Corporation's failure to complete the work. Includes a letter from Tom Bacon, Solicitor (acting on behalf of the Jesuit Fathers), 9 Clare Street, Dublin to Fr McDonald SJ Remarks 'This matter has taken a new and interesting turn... Mr Beausang (Dublin Corporation).. .explained his predicament. Apparently in his final anxiety to get the work through he agreed our terms without obtaining any additional estimates as to the cost... Mr Beausang states that there is a deficiency of at least £7,000...There is no fund out of which this deficiency can be met...Mr Beausang's first suggestion was that the Jesuit Fathers would make a grant to the corporation of half the increased cost namely £3,500. When he was told that this was out of the question it was then suggested that you might disclaim the acquisition money £2,000.' (11 October 1956, 3pp).

Material relating to the 'Bruton Controversy/Debt'

A file relating to the 'Bruton Controversy/Debt'. In February 1884, Dr Bruton, a Dublin merchant transferred, to the Apostolic School, Mungret, a debt of £869.2.6 owed to him by Clongowes. According to Bruton's document of transfer, Clongowes was to pay the debt within a reasonable time, and, pending the payment of the principal sum was to pay, in addition, 3% yearly interest to the Apostolic School. Clongowes refused to pay the principal sum or the interest Includes a letter from Irish Fr Provincial Thomas V. Nolan SJ, St Francis Xavier's, Upper Gardiner Street, Dublin to Rector, Fr James Corboy SJ, Mungret College remarking that he has instructed Fr Nicholas J Tomkin SJ, Rector of Clongowes to pay £332.15.4 to Mungret. Remarks that Fr General decided that Clongowes should pay half the interest due on the debt and '…put an end finally to all disputes about the debt.' (25 June 1917, 2pp).

  • letter seeking information on St Malachy for an article Fr Dunning wishes to write in the school magazine and expressing surprise at the apparent lack of interest, on the part of the Irish, in St Malachy (18 January 1973, 2pp);
  • letter seeking information for a lecture he is going to give to the London Medieval Society on ‘The attitude of the Irish Church to the Norman Invasion’ (13 November 1974, 3pp);
  • letter on his brother Tom’s ‘valuable collection on Old and Middle English Literature’ which has been offered to U.C.D.. Includes a memorial card of Prof. Thomas P. Dunning, C.M. who died in 4 May 1973.

A file relating to the controversy surrounding the Apostolic and Lay Schools, Mungret College and the separation of the two schools following intervention by the Bishop of Limerick and a Decree of Propaganda. Includes correspondence relating to the valuation of the property and the question of the ownership of the Mungret property. Includes a certificate of valuation (25 June 1921, 7pp) and various financial accounts. Includes a ground floor plan and front elevation of Mungret College. Finally, in 1928 a further session of the Sacred Congregation for the Propagation of the Faith decided the transference of the Lay School should not be insisted on but that the two schools should be administered separately (21 April 1928, 1p). Includes letters from Michael Curly, Archbishop of Baltimore offering his support to Mungret College. Paintings in Rathfarnham Castle

A file relating to the paintings in Rathfarnham Castle. Includes letters relating to the ceiling paintings by Angelica Kauffman and new decorative works. Includes letters from Joshua Clarke, J Clarke & Sons, Stain glass manufacturers & Church decorators, 33 North Frederick Street, Dublin regarding the ceiling painting by 'my lady artist' (Miss Crilly, later known as Margaret Clarke) (10 September 1913). Only one painting by Margaret Crilly was accepted, which disappointed Joshua Clarke. Initially Miss Crilly rejected the offer of £7 10 shlllings per painting. Joshua Clarke persuaded her to accept £7, but by this stage, it was too late. She received £10 for her painting and Cambridge & Co. Ltd, Dublin were engaged (October 1913), and agreed a price of £35 for the series of nine painting. The artist Patrick Tuohy completed the ceiling paintings.

Case for counsel on behalf of Rev. Thomas A. Finlay and George O'Brien Esquire and Counsel’s opinion on settling the draft Deed of Trust. Provides the background to the Rural Industries Trust Fund. Joseph H. Murray, one of the trustees of the Fund has recently died and they wish to know if the other two trustees remain secure in their position but with the power of adding to the number of trustees if required. ‘It is desired that the Trustees should have the widest possible powers as to the manner in which they may carry out the Trust…Counsel will please settle Draft Deed and advise.’
